At Mercados Eléctricos Ltda. we respect the privacy of those who visit our website and contact us. This policy explains what personal data we collect, how we use it, who we share it with and how you can exercise your rights, in accordance with Chilean personal data protection law: Law No. 19,628 on the Protection of Private Life and Law No. 21,719, which amends it and applies from December 1, 2026.

2. Personal data we process

We only process the data you voluntarily provide and a minimum of technical data required for the operation and security of the site:

• Contact forms and virtual assistant: name, email address, phone (optional), company (optional), service of interest and the message you write.
• WhatsApp: if you choose to chat via WhatsApp, we will receive your phone number, your profile name and the messages you send us through that app.
• Technical data: IP address, date and time of the visit and browser type, automatically logged by our hosting provider. To prevent bulk messages sent by bots, we also log, in encrypted form, the IP address from which each form is submitted.

We do not request sensitive data (for example, health data, ethnic origin or political opinions). Please do not include them in your messages.

3. How we use your data

• To answer your inquiries and requests for information.
• To arrange meetings and prepare consulting service proposals.
• To maintain communication with clients and prospective clients during the business relationship.
• To protect the site and forms against spam and abuse.
• To comply with legal obligations where applicable.

We do not sell or rent your data, and we do not use it to send you advertising without your prior consent.

4. Legal basis

We process your data on the basis of your consent, which you give by ticking the acceptance box on the form or by confirming the submission in the virtual assistant. Technical security data is processed on the basis of our legitimate interest in protecting the site. You may withdraw your consent at any time, without retroactive effect, by writing to the email address given in section 1.

5. Who we share your data with

Your data is processed by the Mercados Eléctricos team handling your request. The following providers are also involved, only to the extent necessary to provide the service:

• Hosting and email provider of the site, which hosts the site and transmits form messages.
• Google, which provides the site's typeface (Google Fonts) and the location map (Google Maps). When these features load, your browser connects to Google servers, which may receive your IP address.
• WhatsApp (Meta), only if you choose to contact us that way. In that case, processing by WhatsApp is governed by its own privacy policies.

Some of these providers may store data on servers located outside Chile. We do not disclose your data to other third parties, except where required by law or by a competent authority.

6. How long we keep your data

• Inquiries and requests: for as long as necessary to answer them and, if no business relationship results, up to 24 months from the last contact.
• Clients: for the duration of the contractual relationship and, thereafter, for the periods required by applicable legal, tax or contractual obligations.
• Form security log: a maximum of 24 hours.

Once these periods have expired, we delete or anonymize the data.

7. Your rights

As the data subject, you may exercise the following rights at any time:

• Access: to know whether we process your data, which data and for what purposes.
• Rectification: to correct inaccurate, outdated or incomplete data.
• Erasure: to ask us to delete your data when it is no longer needed or you have withdrawn your consent.
• Objection: to object to certain processing.
• Portability: to receive your data in a structured, commonly used format.
• Blocking: to request the temporary suspension of processing while a request is being resolved.

To exercise them, write to us at contacto@mercadoselectricos.cl with the subject line «Datos personales» (Personal data), stating your name, the right you wish to exercise and a means of contact. We may ask for additional information to verify your identity. We will respond within the time limits set by law, and exercising these rights is free of charge.

If you believe we have not handled your request properly, you may file a complaint with the Personal Data Protection Agency (Agencia de Protección de Datos Personales), in accordance with Law No. 21,719.

8. Security

We apply reasonable technical and organizational measures to protect your data: the site uses an encrypted connection (HTTPS), access to messages is restricted to the staff who need it, and the forms are protected against automated use. No system is completely infallible; if we detect a security incident affecting your data, we will report it as required by law.

9. Cookies and storage in your browser

This site does not use its own tracking, analytics or advertising cookies.

• The virtual assistant stores the conversation in your browser's temporary storage (sessionStorage) so it is kept while you move between pages. This information is not sent to our servers and is deleted when you close the tab. Only what you confirm in a request is sent to us.
• The Google Maps map on the About us page may set Google cookies. You can block or delete them in your browser settings.

10. Minors

Our services are aimed at companies and institutions. We do not knowingly collect data from minors. If you believe a minor has provided us with data, write to us and we will delete it.

11. Changes to this policy

We may update this policy to reflect legal changes or changes in how the site works. We will publish the current version on this page, together with its last updated date.
